Terms & Conditions

By confirming his/her wish for Blueworld Translations to perform a translation service for the Client, the Client enters into a binding agreement with Blueworld Translations subject to the following terms and conditions.

1. Definitions

"Blueworld" means Blueworld Translations. "Work" means any translation or any other work undertaken by or any other services supplied by Blueworld Translation. "Client" means any person to whom Blueworld Translations shall supply work.

2. Quotations

Verbal quotations are given for guidance only. They are not binding upon Blueworld and are subject to written confirmation on receipt of the text for translation. Written quotations remain valid for 30 days after dispatch unless otherwise stated. The cost of translation is based upon the number of words of text in the source language.
Blueworld reserves the right to make an additional charge to the quoted amount, if after commencement of translation, changes to the source text are advised by the Client. Such additional charges are made on the basis of additional work required. Blueworld will endeavour to take such steps as are necessary to communicate such additional costs to the client as soon as is practicable, but where Blueworld is undertaking work of a time-sensitive nature we ask clients to remember that this might not always be possible. Any such charges will be billed at no higher a rate than those advertised elsewhere on our site.

3. Delivery

Blueworld undertakes to produce the work specified by the customer and agreed by Blueworld to the best of its ability and as soon as reasonably possible in the circumstances, taking into account the deadline required by the customer.
Blueworld's Emergency Service stating "next day delivery" refers to the duration of time from when details are received required to proceed with the translation to the time that an email of the translated text is sent to the Client. In some cases, Blueworld may need longer than the requested period to perform a translation and will inform you of this either when sending a quote or through some other measure.

Delivery is deemed to have taken place on posting, faxing or electronic delivery to a carrier, as the case may be, and the risk shall pass to the Client.

4. Payment

An invoice for payment will be dispatched to the Client via email shortly after completion. It is the clients responsibility to notify Blueworld if this invoice is not received.

Payments for all work shall be made upon receipt of invoice unless specifically agreed in writing by Blueworld, although in some circumstances payment or part payment may be requested prior to the commencement of the work. Without prejudice to the company's other rights, Blueworld reserves the right to levy a service charge of 2% per month on all balances outstanding beyond the due date.

Various methods (including legal methods) may be employed to recover late payments. The client will be liable for any costs incurred by these methods, as well as interest as outlined above or at such other rate as a Court may deem appropriate.

5. Copyright and Confidentiality

The Client confirms and or indemnifies that he owns or that he has obtained all necessary consent for the translation/artwork to be made insofar as copyright subsists in any and all material provided to and to be worked on by Blueworld. Under the Copyright Act 1956 (as amended etc) , copyright subsists in the translation of any text: In agreeing to translate any text or reproduce artwork Blueworld impliedly licenses insofar as it is able to do so the reproduction or publication of the translation/artwork. However, in the event that payment is not received in accordance with the previous paragraph the said licence shall be automatically revoked and the Client shall not be at liberty to make use of any translation and/or work in which the copyright of Blueworld subsists, and Blueworld reserve the right, immediately and without notice, to pirsue such proceedings, whether by interlocutory application or howsoever otherwise, to enforce its rights under this paragraph, including any and all such applications as they may relate to the delivery up of translated material, whether in the possession power custody or control of the client or any Third Party. The Client shall hereby be deemed to Agree to supply Blueworld with the names and full addresses of any and all Third Parties who are or who have been in possession of material or who have contracted with any such Client for the provision of any such material, and or any other material or facts in which Blueworld may have a legitimate interest based upon the forgoing.

Any original documentation or information provided by the Client as confidential, and any translated work, shall be kept confidential as far as is reasonably practicable by Blueworld, save insofar as any document, material or other item shall fall into the hands of any Third Party by virtue of any criminal act. But the foregoing shall not apply to any documentation, data or other information that are public knowledge at the time when they are so provided by either party, and shall cease to apply if at any future time they become public knowledge through no fault of Blueworld.

6. Rates and Charges

Blueworld tries to keep all published rates correct and up to date. However, Blueworld reserves the right to change them without notice.

7. Liability

a) In all cases liability will be limited to any monies received on account of translation work that is accepted as being inaccurate, and in no case is any responsibility or liability accepted for any consequential losses imputed as caused by said inaccuracy.

b) Blueworld shall have no liability to the Client for any loss, consequential or otherwise, damage, costs, expenses or other claims for compensation arising from any original documentation or instructions supplied by the Client that are incomplete, inaccurate, incorrect, illegible, out of sequence or in the wrong form, or arising from their late arrival or non-arrival, or any other fault of the Client.

c) Blueworld shall have no liability to the Client or be deemed in breach of the agreement by reason of any delay due to any cause beyond Blueworld's reasonable control.

8. Disputes

Any disagreement with the accuracy of translation or other services must be advised, in writing, within five working days of receipt of the completed assignment by the customer for the above to apply.

Blueworld agrees to rectify at no charge any errors or omissions which are at the fault of Blueworld where the errors and omissions amount to a maximum of 5% of the fee value of the project.

9. Governing Law and Jurisdiction

This agreement shall be governed by the applicable Law of England & Wales only and the parties hereby submit to the exclusive jurisdiction of the Courts of England & Wales.

Blueworld must be informed in person of any complaint or legal action pursued against it or any person or persons associated with it within 3 months of the client's submission of a text for translation. Detailed records will normally be destroyed after this period.

10. General

The Client agrees that save in respect of any statements made fraudulently, he/she shall have no remedy in respect of any untrue statement upon which he/she relied in entering this Agreement and that its only remedies shall be for breach of contract.

The headings in these conditions are for ease of reference only and shall not affect the interpretation of any of the conditions
Blueworld reserves the right to change any or all of these conditions at our discretion.

If any term or provision of these Conditions is held invalid illegal or unenforceable for any reason by any Court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

Blueworld may with or without the consent of the Client sublicence or howsoever in any other manner deal with its rights or obligations of any or all parts or part of these Conditions.
